§ 38-27. Committing, creating or maintaining; prohibited acts; abatement.

  • No person shall commit, create or maintain any nuisance.

    (1)

    Prohibited acts. No owner of any parcel of land within the city, or the agent of such owner, shall permit on such parcel of land or upon any sidewalk abutting the land, or upon that portion of any street or alley adjacent to the land between the property line and the curb or traveled portion of such sidewalk or street, any apparatus, structure or item identified in section 38-28 to either accumulate or exist on said parcel, sidewalk or land.

    Abatement by city; billing of owner; failure to pay; lien; collection. If at any time the city manager, or his designee, shall find that the owner or owner's agent has permitted to remain or failed to remove any material, structure, apparatus or item listed in section 38-28, such material, structure or apparatus shall be removed, and the cost of removal shall be billed to the owner at rates established by the city council. Unpaid charges shall become a lien upon the property on which such work has been done or upon the property abutting or adjoining the alley, street, or sidewalk upon which such work has been done and shall be assessed and collected in the same manner as any cost incurred in connection with a single lot or parcel of land.
