§ 22-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Coin machine means all mechanical devices providing amusement, information, entertainment, food or beverage service, vending merchandise or furnishing any service, the operation of which is activated by the insertion of a coin or slug, which is not otherwise licensed under the provisions of this Code.

    Garages means and includes the following:

    (1)

    First class garage means any building, part of a building, lot or space where automotive vehicles are repaired and/or refinished, and the presence of the vehicle is necessary for the particular operation performed.

    (2)

    Second class garage means any building, part of a building, lot or space except first class garages where automotive vehicles are washed or where the following automotive accessories are repaired or replaced: Lamp bulbs and kits; wipers and blades; tires, tubes and patches; valve caps and cores; batteries; spark plugs, chassis fittings, radiator cleaner and repair kit; auto polish and wax; wiping and polishing cloths; touch-up black, top dressing, oil filters, radiator caps; gas tank caps; fan belts; fuses; and hose connections.

    (3)

    Parking garage means any building, part of building lot or space where automotive vehicles are stored for any period, however short, for remuneration, except spaces rented to owners of motor vehicles by the month or longer where no control is retained by the owner of the space of the vehicles so stored.

    Ice cream wholesaler means any person selling or delivering ice cream to retailers for resale. A class B ice cream wholesaler shall be one who manufactures only for his own retail sales; all other wholesalers shall be class A ice cream wholesalers.

    Mechanical amusement rides means any mechanical amusement ride or device or the transportation of persons of the type usually associated with a carnival or street show such as a whip, swings, merry-go-round, ferris wheel, or similar in nature to such devices.

    Operating a dray means:

    (1)

    Operating, using or causing to be driven, or used upon the streets, alleys or public ways of the city any vehicle transporting or delivering earth, dirt, gravel, ashes, sand, slag, stone, cinders, fill material, refuse, rubbish or other similar material, but shall not include any transporting or delivering such material over the streets, alleys or public ways of the city by any person for his own use or in connection with his own business in a vehicle owned by him; or

    (2)

    Operating within the limits of the city any vehicle for the transportation of any freight, express or baggage, or other goods, wares and merchandise from a point of origin within the city or a point within eight miles of the boundaries of the city to a point within the city or to a point within eight miles of the boundaries of the city. Vehicles certificated with the state public service commission shall not thereby be exempt from the provisions of this chapter, if such vehicles are used or offered for hire for the purpose of transporting any freight, express or baggage or other goods, wares or merchandise from a point of origin within the city or a point within eight miles of the boundaries of the city to a point within the city or within eight miles of the boundaries of the city, and such transportation for hire is not a movement or part of a movement requiring action by the state public service commission.

    Wholesale produce dealers means all persons, both principals and agents, who shall by riding, driving, or traveling from place to place, either by horse-drawn or motor vehicle, upon or along the streets of the city, engage in or conduct in the city a business of dealing in, selling, or offering for sale, or taking orders for, or offering to deal in, sell, or take orders for, for the purpose of resale, farm produce, fruits, vegetables, butter, eggs, cheese, dressed poultry, or garden or dairy products.
